Reported October 15, 2026: DOJ and HHS-OIG announced a coordinated route for companies disclosing potential criminal healthcare fraud. A qualifying voluntary disclosure to DOJ’s Fraud Division Health Care Fraud Section also brings HHS-OIG self-disclosure benefits, without a separate OIG portal submission. Reporting only to OIG generally does not count as voluntary disclosure to DOJ. This is not blanket immunity or a route for every billing mistake.
DomAfina’s take: rehearse the escalation before a suspicious pattern appears. Give billing staff a named compliance contact. Preserve original claims, visit records and audit trails; do not rewrite the history. Have experienced healthcare counsel distinguish an ordinary correction or overpayment from potentially criminal conduct and assess the appropriate reporting route. Cooperation and remediation matter.
